Section 10. (A) Notwithstanding any other provision of this chapter, a person may not drive, operate, or be in physical control of a commercial motor vehicle while having alcohol in his system. (B) A person who drives, operates, or is in physical control of a commercial motor vehicle while having alcohol in his system or who refuses to take an alcohol concentration test to determine his blood alcohol content shall be placed out-of-service for twenty-four hours.
