§ 76.002. PESTS. The department shall determine what
organisms constitute pests for purposes of this chapter and may
include in the list of pests:
(1) any insect, snail, slug, rodent, bird, nematode,
fungus, weed, or other form of terrestrial or aquatic plant or
animal life; or
(2) any virus, bacteria, or other microorganism, other
than a virus, bacteria, or other microorganism on or in living man
or other living animals.
