§ 76.1555. ADMINISTRATIVE PENALTY. (a) If a person
violates a provision of this chapter or a rule or order adopted by
the department under this chapter, the department may assess an
administrative penalty against the person as provided by Section
12.020, except that the penalty shall not exceed $4,000 for all
violations related to a single incident.
(b) The department shall establish a schedule stating the
types of violations possible under this chapter. The department is
not required to comply with Subchapter B, Chapter 2001, Government
Code, when establishing or revising the schedule. The department
shall publish the initial schedule and any subsequent revision in
the Texas Register before the schedule or revision is implemented.
(c) If the department elects to assess an administrative
penalty, no action for a civil penalty may be based on the same
violation or violations.
