§ 35.30. WAREHOUSEMAN ISSUING WAREHOUSE RECEIPT WITHOUT GOODS. (a) A warehouseman, his officer, agent, or employee, may not issue a warehouse receipt if he knows at the time of issuance that the goods described in the warehouse receipt are not under his actual control. (b) A warehouseman, his officer, agent, or employee, who violates Subsection (a) of this section is guilty of a felony and upon conviction is punishable by imprisonment in the penitentiary for not more than five years or by a fine of not more than $5,000 or by both.
