§ 40.033. CONSIDERATION TO OFFEROR; LIMITATIONS. (a) An offeror may not notify a person that the person will receive a gift, a condition of receipt of which requires the person to pay consideration of any kind or a charge or expense to a person for the gift, unless the consideration, charge, or expense is fully, clearly, and conspicuously disclosed. (b) An offeror may not charge a redemption fee or shipping fee even if full disclosure of the fee is made. (c) In this section, "redemption or shipping fee" means any kind of consideration paid to the offeror. The term does not include a refundable deposit.
