Art. 44.041. CONDITIONS IN LIEU OF BOND. (a) If a defendant
is confined in county jail pending appeal and is eligible for
release on bond pending appeal but is financially unable to make
bond, the court may release the defendant without bond pending the
conclusion of the appeal only if the court determines that release
under this article is reasonable given the circumstances of the
defendant's offense and the sentence imposed.
(b) A court that releases a defendant under this article
must require the defendant to participate in a program under
Article 42.033, 42.034, 42.035, or 42.036 of this code during the
pendency of the appeal. The defendant may not receive credit toward
completion of the defendant's sentence while participating in a
program required by this subsection.
