Art. 46B.083. SUPPORTING COMMITMENT INFORMATION PROVIDED BY FACILITY HEAD. (a) If the head of the facility believes that the defendant is a person with mental illness and meets the criteria for court-ordered inpatient mental health services under Subtitle C, Title 7, Health and Safety Code, the head of the facility shall have submitted to the court a certificate of medical examination for mental illness. (b) If the head of the facility is of the opinion that the defendant is a person with mental retardation, the head of the facility shall have submitted to the court an affidavit stating the conclusions reached as a result of the examination.
