Art. 46B.106. CIVIL COMMITMENT PLACEMENT: NO FINDING OF VIOLENCE. (a) A defendant committed to a facility as a result of the proceedings initiated under this chapter, other than a defendant described by Article 46B.104, shall be committed to a facility designated by the local mental health authority or local mental retardation authority to serve the catchment area in which the committing court is located. (b) A facility may not refuse to accept a placement ordered under this article on the grounds that criminal charges against the defendant are pending.
