Art. 46B.109. REQUEST BY HEAD OF FACILITY. (a) The head of a facility to which a defendant has been committed as a result of a finding of incompetency to stand trial may request the court to determine that the defendant has been restored to competency. (b) The head of the facility shall provide with the request a written statement that in the opinion of the head of the facility the defendant is competent to stand trial.
