§ 51.9245. ADMISSION OF PERSON RECEIVING ATHLETIC
SCHOLARSHIP. (a) In this section, "general academic teaching
institution" has the meaning assigned by Section 61.003.
(b) A general academic teaching institution may not admit an
applicant who has been promised or granted an athletic scholarship,
grant, or similar financial assistance conditioned on the student's
participation in a sport, game, or other competition involving
substantial physical ability or physical skill for or on a team
organized or sponsored by the general academic teaching institution
that is funded by state funds unless:
(1) if the general academic teaching institution
requires a minimum high school grade point average as an admissions
criterion for any entering freshman, that minimum applies to all
freshmen being admitted; or
(2) for an applicant other than an entering freshman,
the applicant's cumulative college-level grade point average is
equal to or greater than the minimum cumulative college-level grade
point average required for an undergraduate student to remain
enrolled at the institution in the preceding academic year.
