§ 411.067. ADMINISTRATIVE PARKING VIOLATIONS. (a) The
department shall have authority to adopt rules for the assessment
of an administrative fine of $10 for violations of the parking rules
adopted under Section 411.063. Notwithstanding the provisions of
Sections 411.065 and 411.066, the department may in its discretion
issue an administrative citation for a parking violation.
(b) Rules adopted under this section shall:
(1) establish a system for enforcement of
administrative citations including but not limited to assessment of
a late fee not to exceed $2 and towing, impoundment, or
immobilization of vehicles; and
(2) provide for a procedure of administrative review
within the capitol police district and, on request of the person
assessed an administrative fine, further judicial review by the
department filing the appropriate citation or complaint in a court
of competent jurisdiction, as provided in Section 411.066.
(c) The administrative review provided for in Subsection
(b) shall not be considered a contested case under Chapter 2001 or
Chapter 2003.
(d) The department shall remit to the comptroller for
deposit in the general revenue fund any administrative fine
received under this section. Such revenues may be appropriated
only to the department for capitol police security and parking.
