§ 844.211. OPTIONAL BENEFIT ELIGIBILITY PLAN THREE. (a)
The governing body of a participating subdivision may adopt the
plan provisions of this section only on the terms provided by
Subchapter H.
(b) In this section "eligible credited service" means
credited service performed for one or more participating
subdivisions that have adopted the plan provisions of this section.
(c) A member is eligible to apply for and receive a service
retirement annuity if the member:
(1) is less than 60 years old, except as provided by
Subsection (d), and has a sufficient amount of eligible credited
service in the retirement system that, when added to the member's
attained age, equals or exceeds the number 75; or
(2) is eligible for service retirement under any other
provision of this subtitle.
(d) A member who on December 31, 1999, had any eligible
credited service, whose membership in the retirement system
continues after that date without interruption, and who accumulates
four years or more of eligible credited service is eligible to
receive a service retirement annuity regardless of age when the
amount of eligible credited service added to the years of the
member's attained age equals or exceeds the number 75.
