§ 442.106. DELIVERY OF PROPERTY AND RECORDS TO
RECEIVER. (a) The officers, directors, shareholders, members,
trustees, managing general agents, agents, administrators, claims
adjusters, managers, attorneys-in-fact, and associate, deputy, or
substitute attorneys-in-fact of a delinquent insurer shall
immediately deliver to the receiver, without cost to the receiver,
all property, books, records, accounts, documents, and other
writings of the delinquent insurer or that relate to the business of
the delinquent insurer.
(b) If by contract or otherwise any property, book, record,
account, document, or other writing is owned by a person described
by Subsection (a), the owner shall copy the item and deliver the
copy to the receiver. The owner shall retain the original until
notification that the item is no longer required in the
administration of the insurer's estate or until another time as the
court, after notice and hearing, directs. A copy is considered to
be a record of the delinquent insurer under Subchapter I.
