§ 442.207. APPEAL OF RECEIVER'S REJECTION OF CLAIM. (a) The receiver's rejection of a claim may be appealed in the court. The appeal must be brought within three months after the date of service of notice of the rejection. (b) If the receiver's action is appealed within the time prescribed by Subsection (a), review is de novo as if originally filed in the court and is subject to the rules of procedure and appeal applicable to civil cases. The appeal is separate from the delinquency proceeding, and an attempt to appeal the receiver's action by intervening in the delinquency proceeding does not comply with this subsection. (c) If the receiver's action is not appealed within the time prescribed by Subsection (a), the action is final and not subject to judicial review. Added by Acts 2005, 79th Leg., ch. 727, § 1, eff. April 1, 2007.
