§ 442.210. WORKERS' COMPENSATION CLAIMS. (a) The receiver shall notify the Texas Workers' Compensation Commission immediately on a finding of insolvency or impairment with regard to an insurance company that has in force any workers' compensation coverage in this state. (b) On receipt of the notice under Subsection (a), the Texas Workers' Compensation Commission shall submit to the receiver a list of active cases pending before the commission in which: (1) the insurance company has accepted liability; (2) it appears that a bona fide dispute does not exist; (3) payments were begun before the finding of insolvency or impairment; and (4) payment of future or past workers' compensation benefits is due. (c) Notwithstanding the other provisions of this subchapter, the receiver may begin or continue the payment of claims on cases included in the list submitted under Subsection (b). (d) Files and other information delivered by the Texas Workers' Compensation Commission to the receiver may be delivered to the Texas Property and Casualty Insurance Guaranty Association. (e) The Texas Workers' Compensation Commission shall report to the department any act of a workers' compensation insurance company that may indicate that the company is financially impaired, delinquent, or insolvent.
