§ 1703.401. INJUNCTION. (a) If a person violates this chapter, the board's secretary, on direction of a majority of the board and through the attorney general, shall apply in the state's name in district court for an order to enjoin the violation of or to enforce compliance with this chapter. (b) On a finding by a district court in which a verified petition is filed that a person has violated this chapter, the court may issue, without notice or bond, a temporary injunction enjoining a continued violation of this chapter. If it is established at a hearing on the matter that the person has violated or is violating this chapter, the court may issue a permanent injunction to enjoin the violation of or to enforce compliance with this chapter. (c) A proceeding under this section is in addition to any other remedy or penalty provided by this chapter. Acts 1999, 76th Leg., ch. 388, § 1, eff. Sept. 1, 1999.
