§ 10A. NECESSARY PARTY. (a) An institution of higher education as defined by Section 61.003, Education Code, a private institution of higher education, or a charitable organization is a necessary party to a will contest or will construction suit involving a will in which the institution or organization is a distributee. (b) If an institution or organization is a necessary party under Subsection (a) of this section, the court shall serve the institution or organization in the manner provided for service on other parties by this code. Added by Acts 1989, 71st Leg., ch. 1035, § 4, eff. Sept. 1, 1989. Amended by Acts 1991, 72nd Leg., ch. 675, § 1, eff. Sept. 1, 1991.
