§ 161. COMMUNITY ADMINISTRATION. Whenever an interest in
community property passes to someone other than the surviving
spouse, the surviving spouse may qualify as community administrator
in the manner hereinafter provided if
(a) The deceased spouse failed to name an executor in his
will, or
(b) If the executor named in the will of the deceased spouse
is for any reason unable or unwilling to qualify as such, or
(c) If the deceased spouse died intestate.
