§ 372. VALIDATION OF CERTAIN LEASES AND POOLING OR
UNITIZATION AGREEMENTS BASED ON PREVIOUS STATUTES. All presently
existing leases on the oil, gas, or other minerals, or one or more
of them, belonging to the estates of decedents, and all agreements
with respect to pooling, or unitization thereof, or one or more of
them, or any interest therein, with like properties of others
having been authorized by the court having venue, and executed and
delivered by the executors, administrators, or other fiduciaries of
their estates in substantial conformity to the rules set forth in
statutes heretofore existing, providing for only seven days notice
in some instances, and also for a brief order designating a time and
place for hearing, are hereby validated in so far as said period of
notice is concerned, and in so far as the absence of any order
setting a time and place for hearing is concerned; provided, this
shall not apply to any lease or pooling or unitization agreement
involved in any suit pending on the effective date of this Code
wherein either the length of time of said notice or the absence of
such order is in issue.
