§ 223.003. NOTICE BY MAIL. (a) A person may apply to have the name of the person placed on a mailing list to receive notice of any proposed contracts. (b) The department shall mail the notice to each person on that mailing list. (c) The department may require each applicant to pay an annual subscription fee set by the department in an amount not to exceed the average annual costs of mailing notices to the applicant. (d) The department shall deposit money received under this section to the credit of the state highway fund. Acts 1995, 74th Leg., ch. 165, § 1, eff. Sept. 1, 1995. (a) The commission by rule may allow bids on a contract estimated by the department to involve an amount less than $300,000 to be filed with the district engineer at the headquarters for the district in which the improvement is to be made and opened and read at a public meeting held by the district engineer or the district engineer's designee. (b) The commission may delegate to the director or the director's designee the right to: (1) accept or reject bids received, subject to Section 223.045; and (2) award a contract to the lowest bidder.
