Art. 6546. FREIGHT INTERURBANS. All electric, gas or
gasoline, denatured alcohol or naphtha interurban or motor railways
incorporated as such, which shall engage in transporting freight,
shall be subject to the control of the Railroad Commission. No such
corporation shall ever be exempt from the payment of assessments
that may be legally levied or assessed against it for street
improvements. Such interurban railways shall have the same right
of eminent domain as are now given by law to steam railroads, and
may exercise such right for the purpose of acquiring right of way
upon which to construct their railway lines, and sites for depots
and power plants, and shall have the same rights, powers and
privileges as are now granted by law to interurban electric
railways companies. Any such interurban company shall have the
right and authority to acquire, hold and operate other public
utilities in and adjacent to the cities or towns within or through
which said company operates. No property upon which is located a
cemetery shall ever be condemned by any such interurban railway,
unless it shall affirmatively be shown, and so found by the court
trying such condemnation suit, that it is necessary to take such
property, and no other route is possible or practicable.
