          Appeal No. 2000-1038
          Application No. 08/888,042

Under these circumstances, we are convinced that the
examiner’s § 103 rejection is fatally premised upon
impermissible hindsight. See W.L. Gore & Assocs. v. Garlock,
          Inc., 721 F.2d 1540, 1553, 220 USPQ 303, 312-13 (Fed. Cir.
          1983), cert. denied, 469 U.S. 851 (1984). For the reasons
indicated supra, we reverse the examiner’s decision rejecting
all of the appealed claims under 35 U.S.C. § 103.
