          Appeal No. 2001-2542
          Application No. 09/000,760

The executable module of Radziewicz, which is installed on the
client device, serves only to passively provide a window on the
client device for displaying advertisements sent from a network
when the communications line is idle. This module plays no role
in retrieving the data or in controlling its presentation to the
user. Hashimoto discloses nothing more than a computer system in
which a client device can retrieve and display document
information from a network. The examiner proposes to provide
this retrieval and display feature to Radziewicz even though
Radziewicz already controls the information which will be
displayed to the user. We agree with appellants that there is no
apparent basis, other than to recreate appellants’ invention in
hindsight, for the artisan to consider combining the teachings of
Hashimoto with the teachings of Radziewicz.
