            Application No. 10/076,405

                                           BACKGROUND
The appellants' invention relates to an integrated collision prediction and safety
systems control methodology for improved vehicle safety (specification, p. 1). A copy of
the claims under appeal is set forth in the appendix to the appellants' brief.

The prior art references of record relied upon by the examiner in rejecting the
            appealed claims are:
Uemura et al. (Uemura) 5,530,651 June 25, 1996
Breed et al. (Breed) 6,405,132 June 11, 2002

                  Claims 1 to 6, 11 and 16 to 20 stand rejected under 35 U.S.C. § 102(b) as being
            anticipated by Uemura.

                  Claims 12, 14 and 15 stand rejected under 35 U.S.C. § 103 as being
unpatentable over Uemura in view of Breed.

Rather than reiterate the conflicting viewpoints advanced by the examiner and
the appellants regarding the above-noted rejections, we make reference to the final
rejection (mailed July 1, 2003) and the answer (mailed March 24, 2004) for the
