that is why Appellants have not relied on the authority cited by our
distinguished colleague. Indeed, Appellants have not established on this
record that their definition of “side by side” is the only one accepted in the
relevant art, to the exclusion of the dictionary definition that is not in
dispute.
In conclusion, based on the foregoing and the reasons well stated by
the Examiner, the Examiner's decision rejecting the appealed claims is
affirmed.
No time period for taking any subsequent action in connection with
this appeal may be extended under 37 C.F.R. § 1.136(a)(iv) (effective Sept.
13, 2004).
