DECISION ON APPEAL
STATEMENT OF THE CASE
Mory Gharib and Paul S. Krueger (Appellants) appeal under
35 U.S.C. § 134 from the Examiner’s decision rejecting claims 2-7. We
have jurisdiction over this appeal under 35 U.S.C. § 6 (2002). Appellants
waived the oral argument set for October 25, 2007 at 1:00 PM (waiver filed
September 5, 2007). We therefore reach our decision in this appeal on the
basis of Appellants’ Appeal Brief (filed February 28, 2006) and the
Examiner’s Answer (mailed April 27, 2006) thereto.
