Enforcement procedures

Sec. 3. (a) A police officer who has reason to believe that a
vehicle or the load on a vehicle is unlawful may do the following:
(1) Stop, measure, and weigh the vehicle or load on a highway
by means of portable or stationary scales.
(2) Require the vehicle to be driven to the nearest scales if the
nearest scales are within five (5) miles. However, a vehicle
carrying a load of asphalt or concrete in the plastic stage may
not be required to be driven more than two (2) miles to the
nearest scales.
(b) If an officer finds that a vehicle is loaded in violation of this
article, the officer may cause the excess load to be removed from the
vehicle. Material or goods that are removed shall be removed and
cared for at the risk of the person who owns or operates the vehicle.
