Nevada Revised Statutes Section 590.050 - Food and Other Commodities

False or misleading advertising prohibited.

1. It is unlawful for any person, or any officer, agent or employee thereof, engaged in or operating in the business of selling at retail any gasoline or diesel fuel as fuel for internal combustion engines, or lubricating oil for internal combustion engines, to display any sign or other designating mark, at or near his place of business, which describes or designates a brand or trade name of a gasoline, diesel fuel or lubricating oil for internal combustion engines not actually sold or offered for sale or delivery at the place of business where the sign or other designating mark is displayed.

2. It is unlawful for any person or officer, agent or employee thereof, to make or cause to be made, by means of any advertising medium whatever, any statement concerning the sale of petroleum products or the performance characteristics thereof which is known to him to be untrue or misleading, or which by the exercise of reasonable care and diligence should be known to him to be untrue or misleading.
