Trust for related provider: Required agreement between trustee and provider. The trustee of a trust for a related provider must agree in writing with the provider of viatical settlements that the provider is responsible for ensuring compliance with all statutory and regulatory requirements and that the trustee will make all records and files related to viatical settlements available to the Commissioner as if those records and files were maintained directly by the provider.
