Oregon Statutes - Chapter 583 - Milk Marketing, Production and Distribution - Section 583.500 - Hearing required before order issued; considerations in establishing minimum prices.

(1) Before making any order under ORS 583.505, the State Department of Agriculture shall hold a public hearing in the market area to be affected by the order. The order shall be made within 30 days after the hearing.

(2) In establishing minimum prices under ORS 583.505 and this section, the department may take into consideration, with regard to the market area to be affected by the order:

(a) Average price per hundredweight for manufacturing milk, f.o.b. plants in Wisconsin and Minnesota, as reported monthly by the United States Department of Agriculture.

(b) Price of Class 1 and Class 2 milk in adjacent states.

(c) Cost of transporting milk.

(d) Prevailing price for manufacturing grade milk used in products which are sold in competition with similar products made from Grade A milk.

(e) Available supply of milk for human consumption in relations to actual consumption thereof.

(f) Cost of producing Grade A milk, especially sanitary measures necessary to insure the purity and wholesomeness of the milk, leveling out of seasonal production to meet requirements of the market and such other factors as are pertinent. [1963 c.442 §14]
