(a) The Virginia Board of Agriculture and Consumer Services shall establish, and from time to time may amend or revise standards, grades, and size-weight classes including standards for the term "ungraded" for eggs marketed in this Commonwealth. In administering this article, the Virginia Department of Agriculture and Consumer Services shall have due regard for the desirability or uniformity in the standards, grades, and size-weight classes for eggs moving in intrastate and interstate commerce.
(b) Cracked or checked eggs labeled as "cracks" may be sold only by producers or processors directly to consumers or for further processing, excluding institutional consumers.
