          Appeal No. 2003-1392
          Application No. 09/593,867

          lines 18 through 23) that
[w]hen a part of interest of the image displayed
on the area 23, that is, the image for observation
position designation is selected and designated by
               operating a position designator 28 (S6), a position
signal of that designated part is read out of the
storage unit 16 and supplied to the specimen stage
               drive unit 19.
As a result thereof, Iwabuchi automatically moves the specimen
stage, and correspondingly the specimen, to a position
corresponding to the selected specimen image (column 3, lines 23
through 31). Accordingly, the obviousness rejection of claim 5
is sustained. The obviousness rejection of claims 6 through 8 is
sustained because appellants have chosen to let these claims
stand or fall with claim 5 (brief, page 3).
                                      DECISION
The decision of the examiner rejecting claims 1 through 4
under 35 U.S.C. § 102(e) is affirmed, and the decision of the
          examiner rejecting claims 5 through 8 under 35 U.S.C. § 103(a) is
          affirmed.

                                          5
