             Appeal 2007-1331
             Application 10/296,814
                                            FINDINGS OF FACT
We find that the following enumerated findings are supported by at least a
             preponderance of the evidence. Ethicon, Inc. v. Quigg, 849 F.2d 1422, 1427, 7
USPQ2d 1152, 1156 (Fed. Cir. 1988) (explaining the general evidentiary standard
             for proceedings before the Office).
                   1. The customary meaning of “axis” is “A straight line about which a
body or geometric object rotates or may be conceived to rotate.” The
American Heritage Dictionary of the English Language (4th ed. 2000).
                   2. The Appellants’ Specification describes throughout the disclosure a
table unit having “two table elements [that] can be rotated relative to
one another around at least two different swiveling axes by way of
                        articulations” (Specification 3:5-7, 5:11-13, and 7:1-7).
                   3. The Appellants’ Specification also describes a middle articulation that
is a multiple joint allowing rotation about two different axes
                        (Specification 7:1-7).
                   4. Dixon discloses a tray table 10 mounted in a passenger seat 11, where
the tray table 10 includes a table top 21 formed of a pair of table top
                        sections 21A and 21B (Dixon, col. 3, ll. 23-24 and 52-53).
                   5. Dixon discloses that the table top sections 21A and 21B are hinged
along an axis by hinge assemblies 23 and 24 such that table top section
21B may be pivoted away from table top section 21A to create a full-
length table, such that the table top section 21A is capable of rotating

                                                      5
