1 FACTS PERTINENT TO THE ISSUES
2 The following enumerated Findings of Fact (FF) are believed to be supported
3 by a preponderance of the evidence.
4 Treyz
5 01. Treyz is directed toward system that allows users with handheld
6 computing devices to obtain information using local and remote wireless
7 links and to order products and services (Treyz 1:41-44).
8 02. Treyz’s handheld computing device may have an expansion slot that
9 accepts accessories such as local wireless communications accessories.
10 Accessories may include a bar code scanner, a radio-frequency
11 identification (RFID) unit, a smart card attachment, etc. These
12 attachments may be integrated into the handheld computing device if
13 desired (Treyz 1:52-57)).
14 03. Treyz’s handheld computing device may communicate with a
15 merchant over a wireless communications link. For example, the
16 handheld computing device may communicate with the merchant over a
17 remote wireless link (Treyz 2:11-14).
18 04. Treyz’s handheld computing device may display price comparison
19 information for the user while the user is in a store. Product information
20 may also be displayed by the handheld computing device when the user
21 is in the store. Product information from multiple manufacturers may be
22 obtained. If desired, product information may be organized in various
23 product-categories. The handheld computing device may allow the user
24 to search for information on products and manufacturers of interest
