(a)(1) Upon the date of adoption of a resolution of the Geneva County Commission declaring the implementation of this section, an additional special recording fee of five dollars ($5) shall be charged and collected by the Judge of Probate of Geneva County for each real property instrument, personal property instrument, or any other document or instrument filed for record in the office of the judge of probate.
(2) On and after the date of adoption, no document or instrument shall be received for record in the office of the judge of probate unless the special recording fee provided for in subdivision (1) is paid.
(3) The special recording fee provided by this section shall be in addition to any other fees, taxes, or other charges required by law to be paid upon the filing for record of any real property instrument, personal property instrument, or any other document or instrument in the office of the judge of probate.
(b)(1) Two dollars ($2) of the special recording fee collected pursuant to this section shall be deposited by the office of the judge of probate into a special fund to be earmarked for the preservation and restoration of court records and documents in the office of the judge of probate and for the operation of the office of the judge of probate.
(2) The remainder of the proceeds from the special recording fee collected pursuant to this section, including all of the proceeds from any future increase in the special recording fee provided by this section, shall be deposited into the county general fund to be used for general county purposes.
(c) The amount of the special recording fee provided by this section may be adjusted and increased from time to time by the Geneva County Commission, with the fee amount not to exceed ten dollars ($10).
