Section 45-49-233.01 - Fees for services.

(a) The Sheriff of Mobile County shall be entitled to receive the following fees for the services as listed below in civil and criminal cases:

SERVICE FEE

(1) Levying attachment.$25
(2) Summoning garnishee and making return.$10
(3) Garnishment notice to defendant. $10
(4) Serving summons and other mesne process, except subpoenas for witnesses, and returning same.$10
(5) Summoning each witness and returning subpoenas.$ 5
(6) Executing a writ of possession.$25
(7) Making a deed to real estate sold. $25
(8) Serving summons and making returns in cases of forcible entry and detainer.$25
(9) Executing writs of restitution in such cases. $25
(10) Collecting execution for cost only. $25
(11) Serving subpoenas on bill in chancery proceedings and returning the same, for each defendant. $25
(12) Serving any court summons not herein provided for and making return. $10
(13) Serving attachment for contempt of court or rule to show cause.$10
(14) Taking and approving bonds of every kind.$10
(15) Collecting money under execution but no commission shall be collected on costs. $25
(16) Seizing personal property under writ of detinue. $25
(17) Summoning jurors. $ 5
(18) Executing body writs in mental cases. $25
(19) Executing a search warrant by day. $ 3
(20) Executing a search warrant by night.$ 6
(21) Executing a warrant or writ of arrest in misdemeanor or felony cases. $12
(22) Each bond or undertaking returned to court. $ 6
(23) Serving subpoena, notice, or scire facias. $ 4
(24) Summoning jury in capital cases, or at any special court for the trial of a criminal, to be paid out of the county treasury.$12
(25) Attendance at circuit or county court in criminal cases, per day, to be paid out of the county treasury. $12
(26) Lawful commitment of a prisoner to jail. $ 6
(27) Removing a prisoner from the county where his or her offense was committed when there is no jail or the jail is insecure, to the jail of this or another county, and for returning the prisoner, for the sheriff and each deputy or guard for each day they engage in such removal or return, plus their actual necessary traveling expenses including those of the prisoner, to be taxed against and paid by such prisoner upon conviction, or, if such prisoner is insolvent or is acquitted, to be paid by the county in which the offense was committed. $15
(28) Removing or returning a prisoner upon a change of venue order, for the sheriff and each deputy or guard for each day they engage in such removal or return, plus their actual necessary traveling expenses, including those of the prison- er, to be taxed against and paid by such prisoner upon conviction, or, if such prisoner is insolvent or is acquitted, to be paid by the state in cases involving felony offenses and to be paid out of the county treasury in cases involving misdemeanor offenses. $15
(29) Capture or arrest of a defendant with contraband or prohibited liquors or beverages, in addition to any other fees and charges allowed by law, eighteen cents ($0.18) per mile from the courthouse to the place of the capture or arrest and all expenses in transporting the contraband, etc., from the place of capture or arrest, to the courthouse, to be paid by the defendant upon conviction. $15
(30) Taking fingerprints of persons taken into custody and furnishing copies thereof to the Director of the Federal Bureau of Investigation and the Secretary of the Alabama State Law Enforcement Agency. $ 3

(b) The aforementioned sheriff's fees in civil cases shall be collected by the sheriff at the time of filing in court and paid into the General Fund of Mobile County consistent with Section 36-22-17, and shall be in addition to any other fees presently collected.

(c) The aforementioned sheriff's fees in criminal cases shall be paid by the defendant and shall be collected by the sheriff and paid into the General Fund of Mobile County consistent with Section 36-22-17.

(d) The aforementioned sheriff's fees for executing body writs for mental patients shall be assessed against the petitioner and shall be collected by the sheriff and paid into the General Fund of Mobile County.
