Section 45-49A-63.102 - Member contributions.

Eight percent of the salary of every uniformed officer with less than 30 years of service shall be deducted from his or her pay and shall be transferred to the fund on a monthly basis. No amounts shall be deducted from the pay of a uniformed officer who has at least 30 years of service. Records shall be kept by the board showing the amount contributed by each uniformed officer. The uniformed officers’ contributions required by this section are mandatory. The contributions under this section are designated as member contributions; however, the contributions shall be picked up by the city and shall be treated as paid by the city in lieu of contributions by members in accordance with Section 414(h)(2) of the code. The member does not have the option to receive any amounts contributed by the city under this section in cash. If the city’s contribution to the plan under Section 45-49A-63.104 is zero for a plan year, the board may decrease the contributions by the members under this section pro rata during that plan year as determined by the actuary designated by the board under Section 45-49A-63.104 provided the sum of the amounts contributed under this section and Sections 45-49A-63.100, 45-49A-63.101, and 45-49A-63.103 shall be at least equal to the annual actuarial cost as determined under subsection (c) of Section 45-49A-63.104 for such plan year and the board finds the proposed reduction will not have a material adverse impact on the funding of the plan.
