Section 45-9-20.02 - Alcoholic beverage sales on Sunday outside corporate limits of Cities of Valley and Lanett.

(a) This section applies in Chambers County outside of the corporate limits of the City of Valley and the City of Lanett.

(b) The sale of alcoholic beverages after 12:00 p.m. on Sundays may be authorized by the Chambers County Commission outside of the corporate limits of the City of Valley and the City of Lanett after approval by a referendum as provided in this section. If the Sunday sale of alcoholic beverages is approved by a referendum, the county commission, by ordinance, may permit the sale and consumption of alcoholic beverages on Sunday after 12:00 p.m. as determined by the county commission by properly licensed retail licensees of the Alcoholic Beverage Control Board outside of the corporate limits of the City of Valley and the City of Lanett. Pursuant to this authority, the county commission may regulate which retail licensees may sell alcoholic beverages on Sunday, whether the sale may be for off-premises consumption, and any other aspect of the Sunday sale of alcoholic beverages.

(c) The county commission shall hold a referendum to determine if the public favors the sale of alcoholic beverages on Sunday after 12:00 p.m. outside of the corporate limits of the City of Valley and the City of Lanett. If a majority of the voters voting thereon vote in favor of the question, then the sale of alcoholic beverages after 12:00 p.m. on Sunday outside of the corporate limits of the City of Valley and the City of Lanett may be provided for by the county commission.

(d) The referendum shall be held at the next primary or general election. Costs of the referendum shall be paid by the county commission. A second or subsequent referendum shall not be held within 12 months following a referendum which fails to be approved.
