A conviction for violation of ยง 5-36-103 shall not be a condition precedent to maintenance of a civil action authorized by this subchapter and nothing in this subchapter shall prohibit or limit any other course of action a retailer or merchant may have against a person who unlawfully takes cash, goods, wares, or merchandise from the merchant's premises.
