Additionally, claims 45, 59 and 62 stand rejected based on the judicially-created doctrine of obviousness-type double patenting over claims 1 and 9 of U.S. Patent No. 5,204,320 issued to Patel. THE REJECTION UNDER 35 USC § 103 The appealed claims stand rejected under 35 USC § 103 for obviousness over Uhl. We affirm this rejection essentially for the reasons set forth by the examiner in his Answer.
