Appeal No. 1997-3148 Application 08/408,088 Claims 5 through 8, 14, and 15 stand rejected under 35 U.S.C. § 103 as being unpatentable over Hoeberechts in view of Van Gorkom. We note that on pages 9 and 10 of the brief the Appellants argue that neither Hoeberechts nor Van Gorkom teaches or suggests a relatively high-resistive resistor. We have found that Hoeberechts does teach a relatively high- resistive resistor above and, therefore, we will sustain the Examiner's rejection of these claims as well for the same reasons as above. In view of the foregoing, the decision of the Examiner rejecting claims 12, 13, and 16 through 19 under 35 U.S.C. § 103 is affirmed, and the decision of the Examiner rejecting claims 5 through 8, 14, and 15 under 35 U.S.C. § 103 is affirmed. No time period for taking any subsequent action in con- nection with this appeal may be extended under 37 CFR § 1.136(a).
