Whereas Bernstein, the junior party, has filed a
request for entry of an adverse judgment, pursuant to 37
C.F.R.
§ 1.662(a) judgment as to the subject matter of count 2, the
only count in issue, is hereby awarded to Ljung, the senior
party. Accordingly, the party Bernstein is not entitled to
its patent containing claims 1-10 corresponding to count 2.
