Appeal No. 1998-0696 Page 3 Application No. 08/444,664 The examiner relies on the following references: Hanson 5,436,773 Jul. 25, 1995 (filed Jun. 10, 1994) European Patent Application 479,703 Apr. 8, 1992 Brown et al. (Brown) In addition, the examiner relies on admitted prior art [APA] as specifically set forth at page 2, lines 8-10, of the instant specification. Claims 1 through 9 stand rejected under 35 U.S.C. 103. As evidence of obviousness, the examiner cites APA and Hanson with regard to claims 4 and 7 through 9, adding Brown to this combination with regard to claims 1 through 3, 5 and 6. Reference is made to the brief and answer for the respective positions of appellants and the examiner. OPINION We reverse. It is our view that the examiner has failed to establish a prima facie case of obviousness with regard to the instant claimed subject matter.Page: Previous 1 2 3 4 5 6 7 8 9 NextLast modified: November 3, 2007
