ORDERED that judgment on priority as to Count 1, the
sole count in the interference, is awarded against senior party
DOUGLAS RICE, NADINE CAROZZI, DAVID M. ANDERSON, KANNIAH
RAJASEKARAN, THIRUMALE S. RANGAN, RICHARD L. YENOFSKY, RICHARD
LOTSTEIN, and ANNICK DE FRAMOND;
FURTHER ORDERED that senior party, DOUGLAS RICE,
NADINE CAROZZI, DAVID M. ANDERSON, KANNIAH RAJASEKARAN,
THIRUMALE S. RANGAN, RICHARD L. YENOFSKY, RICHARD LOTSTEIN, and
ANNICK DE FRAMOND, is not entitled to a patent containing claims
85-92 and 95-107, which correspond to Count 1;
FURTHER ORDERED that a copy of this decision be given
a paper number and be entered in the administrative records of
Barton's 07/299,767 application and Rice's 08/218,697
application.
