Appeal No. 98-2735 Application No. 90004386 application (Reexamination Control No. 90/004,386) involving reexamination of U.S. Patent 5,398,915 issued March 21, 1995. This appeal is related to Appeal No. 99-0254, an appeal from a final rejection of the claims pending in an application (Reexamination Control No. 90/004,385) involving reexamination of U.S. Patent 5,320,662 issued June 14, 1994, which is directed to a process for continuous copper smelting. CLAIMED SUBJECT MATTER According to appellants, the claimed subject matter is directed to an "improvement in an apparatus for the continuous smelting of copper." See Brief, page 2, in conjunction with Brief, page 16. Claim 1 is illustrative of the claimed subject matter and reads as follows: Claim 1. An apparatus for smelting copper comprising: blister copper producing means; a plurality of blister copper refining furnaces for refining blister copper into copper of higher quality; and blister copper launder means connecting said blister copper producing means and said blister copper refining furnaces.
