In consideration of the REQUEST FOR ENTRY OF ADVERSE JUDGMENT filed
by the party Beal et al. pursuant to 37 CFR 1.662(a), judgment as to the subject matter
of Count 1 is hereby entered against party Beal et al., who is therefore not entitled to
patent claims 1 through 27, which correspond to the count. As a result, judgment as to
the subject matter of Count 1 is awarded to party Van Tilburg, who is therefore, on this
record, entitled to his application claims 24 through 38, 40, 41, and 43 through 57,
which correspond to the count.
