Appeal No. 2002-0573 Application 09/150,422 appeal, or of an escutcheon fitting which slides over the combined integral drop nipple-reducing coupling assembly for a predetermined distance, as set forth in dependent claim 2. Since we have determined that the teachings and suggestions found in Ballard, Jackson and MacDonald would not have made the subject matter as a whole of independent claims 1 and 4 on appeal obvious to one of ordinary skill in the art at the time of appellant’s invention, we must refuse to sustain the examiner’s rejection of those claims under 35 U.S.C. § 103(a). It follows that the examiner’s rejection of dependent claims 2, 3 and 5 under that same ground will likewise not be sustained. 7Page: Previous 1 2 3 4 5 6 7 8 9 NextLast modified: November 3, 2007
