Appeal No. 2002-1138 Application No. 09/362,785 BACKGROUND The disclosed invention is directed to a self-testing cable modem that is located remote from a cable termination system of a cable network. A signal measurement circuit is used in determining whether the modem is generating electrical noise signals onto the network, so that sources of noise on the network may be identified. Representative claim 1 is reproduced below. 1. A self-testing cable modem located remote from a cable modem termination system (CMTS) of a cable network for testing the cable network, the self-testing cable modem comprising: a cable modem that receives signals over a downstream side of the cable network from the CMTS and transmits signals over an upstream side of the cable network to the CMTS; and a signal measurement circuit responsive to the upstream side of the cable network. The examiner relies on the following references: Sanders et al. (Sanders) 5,893,024 Apr. 6, 1999 (filed Aug. 13, 1996) Claims 1-3 stand rejected under 35 U.S.C. § 102 as being anticipated by Sanders.
