              Dr. Kadow, the Bristol-Myers Squibb researcher who repeated               

    in 1996 Examples 2, 3, 5 and 6 from Chen et al.'s first filed                       

    application, testified that:                                                        

              The cyclopropataxol compounds within the Counts are very                  
              complex. In addition, the discovery that those compounds                  
              were produced by reactions disclosed in the Chen parent                   
              applications was surprising.                                              

    CR 39. In explaining his testimony, Kadow stated that the discovery                 
    was surprising because:
