Appeal No. 2003-1495 Application No. 09/591,968 Claim 31 is the only independent claim on appeal, and it reads as follows: 31. A memory cell comprising: a substrate; a select gate on the substrate, the select gate having an edge; a floating gate on the substrate spaced from the select gate, the floating gate having an edge; and an implanted region aligned with the edges of the select and floating gates, said implanted region being implanted with a species at a dose that is less than 2X1012 atoms per square centimeter. The reference relied on by the examiner is: Chang et al. (Chang) 5,471,422 Nov. 28, 1995 Claims 31 through 36 and 38 stand rejected under 35 U.S.C. § 102(b) as being anticipated by Chang. In the alternative, claims 31 through 36 and 38 stand rejected under 35 U.S.C. § 103(a) as being unpatentable over Chang. Reference is made to the brief (paper number 22) and the answer (paper number 23) for the respective positions of the appellants and the examiner.
